The Developer Applied for permitted use “Tourist Accommodation”
Subdivision was then granted based on Clause 12(2)of the LEP noting subdivision can be granted to create an allotment of less than 40 ha if used for a permissible land use for which consent has been given …….. (note: In 2012 this clause was amended to exclude tourist facilities.)
77 Lots were approved in 2004 as a community Title subdivision – tourist facility, each lot with building entitlement
NOTE: Bentwood Estate is on the boarder of Cessnock and Singleton Council’s with the majority of the Estate being within the Singleton precinct, however, one lot falls into the Cessnock Council and does not have the same ‘’permitted use’’ restriction and is not limited to tourist accommodation, it is less than 40 ha and building permission has been granted.
